Terms of use
Updated on 10 October 2026
1. About these terms
These Terms of Use ("Terms") govern your use of PropertyNaksha, including its website and app (together, the "Service"). "We", "us" and "our" mean PropertyNaksha, run by Amar Pathak, Pehowa, Haryana. "You" means any person who uses the Service.
By using the Service or creating an account, you agree to these Terms and to our Privacy Policy. If you do not agree, you must not use the Service.
These Terms are an electronic record under the Information Technology Act, 2000, and do not need a physical or digital signature.
2. What the Service is
The Service is an online platform where owners, builders and brokers ("sellers") list property for sale in the Kurukshetra, Kaithal and Ambala districts of Haryana, and where buyers can find those listings and contact sellers.
We are an intermediary under Section 79 of the Information Technology Act, 2000. We host content posted by users. We do not create that content and we do not verify that it is accurate.
We are not a real estate agent under the Real Estate (Regulation and Development) Act, 2016, and we are not a broker. We do not negotiate or act for anyone in a sale, and we do not introduce particular buyers to particular sellers. Sellers list properties and buyers contact them directly. We are not a party to any transaction, and we do not receive, hold or transfer any money for the sale or purchase of a property. Our fees are for listing and display only, and are never linked to any sale.
3. Eligibility and accounts
You must be at least 18 years old and able to enter into a binding contract under Indian law. Accounts are created and accessed only through Google sign-in. You are responsible for all activity under your account, including activity by anyone who gains access to your Google account.
Each account is a buyer, builder or broker account, chosen when it is created. You must not create or use more than one account to get around any limit of the Service. You must give your own correct name and mobile number, and keep them up to date. You must not sell, transfer or let anyone else use your account or plan.
We may contact you about your account by app notification, email, phone call or WhatsApp.
We may change or remove any account name, logo or link that is misleading, offensive or uses someone else’s name or brand.
4. Listings
By posting a listing, you confirm that the property is yours to sell, or that its owner has authorised you to list it. If you are a broker, you confirm that the owner has agreed to you carrying the listing. You are solely responsible for every listing you post, and for any legal action that results from information in it being false or misleading. You must keep each listing accurate, and mark it sold or remove it when it is no longer available, including when an owner’s agreement with a broker ends. A broker’s location on the map must be a place where they can actually be found.
Every listing must meet these requirements:
- Every listing must be a real property that its seller owns or has been asked to sell, shown as it is.
- A phone number or other contact cannot go in the listing’s own words. Buyers reach the seller through Call.
- Photos and words must be about the property and fit for anyone to see.
- Only property for sale can be listed.
We review each listing before it is published, only to check it against the rules in sections 4 (Listings) and 8 (Prohibited use) of these Terms. We may approve it, return it to the seller to correct, or decline to publish it. The seller makes every correction. We do not create, rewrite or edit any listing. We do not change its photos, other than automatic processing such as resizing, compression and removing location data.
This review is a check against those rules only. It is not a verification, certification or endorsement of any property, seller or listing. We do not verify ownership or the right to sell, title, encumbrances, approvals, measurements, price, condition, availability, or whether photos or documents are genuine. Approval or display of a listing does not mean that anything in it is accurate. The seller remains responsible for the listing.
We may ask you to show that you have the right to list a property, and remove the listing if you cannot.
Sellers are responsible for complying with every law that applies to them, including any registration required under the Real Estate (Regulation and Development) Act, 2016.
Any agreement about commission, brokerage or who may list a property is between the owner and the broker. We are not a party to it.
5. How listings are displayed
- A free listing is shown on the map as an area circle, not at its exact location.
- A listing under a builder’s plan is shown at its exact location.
- A broker’s listings appear in lists and on the broker’s profile, not on the map. The broker’s chosen location appears on the map.
A PRO or Broker tag shows the type of account only. It is not a verification or endorsement of the seller.
Locations, boundaries and measurements are shown as provided by sellers or map providers, and may not be exact. They must not be relied on to settle any boundary or title question.
We decide how listings are ordered and shown. Paying for a plan does not buy a higher position unless the plan says so.
Some features show accounts by name, such as newly joined builders, rows by category and the list of brokers in a district. These follow fixed rules that apply to everyone, such as when an account joined or where it is. Being shown in them, or not, is not an endorsement and gives no one a claim against us.
We do not take sides between owners, builders and brokers. The Service is open to all of them on the same Terms.
Any counts of views or calls we show you are estimates.
6. Listing periods
- A free listing stays live for 30 days.
- A broker’s listing on a paid plan stays live for 60 days.
- A builder’s listings stay live for as long as the builder’s plan is active.
An expired listing can be made live again at no charge. A free listing marked as sold continues to count as the account’s one free listing for 30 days.
7. Contacting sellers and staying safe
Each listing is posted by its seller. Visit the property and see its papers before you pay anything.
When you choose to call a seller, the seller’s mobile number is shown to you. You may use it only to enquire about that listing.
Sellers may use a buyer’s details only to respond to their enquiry.
We are not responsible for any call, meeting or site visit between users, or for anything that happens during one.
Some people may try to cheat others through listings or calls. Never pay a token, advance or booking amount before you have visited the property, checked its papers and confirmed who the seller is.
We do not handle money between users, and we cannot recover money paid to another user. We are not liable for any fraud, cheating or misrepresentation by another user.
If you believe you have been cheated, report it to the police or at cybercrime.gov.in, and report the listing to us. We may remove any account involved in fraud, and we will share the information we hold with the police when the law requires.
8. Prohibited use
You must not:
- copy listings, photos or mobile numbers in bulk, whether by hand or by automated means;
- access or use the Service by automated means, other than search engines indexing public pages;
- use a seller’s mobile number for any purpose other than enquiring about their listing, including adding it to a list or sending advertisements;
- impersonate any person, or list a property you have no right to sell;
- attempt to gain unauthorised access to the Service, interfere with its operation, or get around its limits;
- post content that is obscene, pornographic or paedophilic, that invades anyone’s privacy including bodily privacy, that insults or harasses anyone on the basis of gender, or that is harmful to children;
- post content that is racially or ethnically objectionable, promotes money laundering or gambling, promotes enmity between groups, threatens the unity, integrity, security or sovereignty of India or public order, contains viruses or harmful code, or is patently false and meant to mislead or harass;
- post a listing for a property that is not available, to draw buyers to other properties;
- make false or malicious reports;
- post anything defamatory about any person or business, or make claims about another seller or their property that you cannot support;
- threaten, abuse or harass us or anyone who works with us, whether on the Service or off it;
- post content that is unlawful, misleading or offensive, or that infringes anyone’s rights;
- use the PropertyNaksha name or logo in a way that suggests we have verified, approved or partnered with you. You may say that your properties are listed on PropertyNaksha and share links to them.
9. Plans, fees and payment
Plans and fees are shown on our Pricing page or in the app. All fees are in Indian rupees. We may change our plans and fees at any time. A change applies from your next renewal, and never to a period you have already paid for.
All fees paid to us are for use of the Service only. They are not a commission, brokerage or share in any property transaction, and we do not charge any commission on the sale or purchase of a property.
We may add any taxes required by law to our fees. They are shown at the time of payment.
- Broker plans are billed monthly and paid by UPI or any other method we offer.
- Builder plans are billed monthly or yearly.
- A plan starts once we have approved it and, where it is paid, confirmed the payment.
- The launch offer lasts six months, is available once per person or business and is subject to availability. We may withdraw it at any time.
A plan ends on its end date, with no grace period. When it ends, your listings are kept but removed from public view, except your most recent listing, or your five most recent listings if you are a broker. No listing is deleted because a plan ends. If you renew, your listings are restored.
If a listing is removed from public view because a plan ended, buyers who open a link to it may still see that it is not listed and call you.
It is your responsibility to renew on time. We may remind you, but we do not have to.
If a payment is reversed, disputed or found to be fake, we may end the plan and the account immediately.
Paid plans do not guarantee any number of views, calls or sales.
Pay only to the payment details shown in the app, or sent to you from the official email address shown on our Contact page. We are not responsible for money paid to anyone else claiming to act for us. We will never ask for your password, or ask you to share a one-time code over a call or message.
Refunds are governed by our Refunds and Cancellation Policy.
10. Removal, restriction and suspension
Any user may report a listing, and we act on reports promptly. We may, at our discretion and without prior notice, remove any listing, or restrict, suspend or terminate any account, if we believe it breaches these Terms or the law, or puts others at risk.
Where content shows the sexual abuse or exploitation of a child, or sexual content of any person shared without their consent, we remove it, preserve it as the law requires, and report it to the authorities. We will cooperate with law enforcement, including by sharing the details of the account that posted it. Anyone may report such content to our Grievance Officer, and we act on it as quickly as the law requires.
We may also take this action for conduct outside the Service that harms the Service, its users or its reputation, including spreading false claims about it.
If we end an account because it breached these Terms, fees already paid are not refunded.
We may also close any account for any other reason by giving 30 days’ notice. In that case, we refund the unused part of any fees paid.
We may report threats, abuse, false complaints or other unlawful conduct to the police.
Where we remove a listing, we tell the seller which requirement it did not meet, and the seller may ask us to review the decision. Deleting an account does not end a restriction or suspension.
If your account is restricted or suspended, you may write to our Grievance Officer to ask us to review it.
11. Deleting your account
You may delete your account from Profile, then Settings. Your account is hidden and you are signed out immediately. If you sign in within 30 days, your account is restored. After 30 days, your account is permanently erased, except for the records described in our Privacy Policy.
12. Your content
You keep ownership of the content you post. You grant us a non-exclusive, royalty-free licence to host, store, reproduce, display and distribute it, including in shared links and search engine results, for the purpose of operating the Service, for as long as it is listed and as needed to keep the records described in our Privacy Policy.
We may keep and use details of listings, such as property type, size, area and price, without any information that identifies you, after a listing or account is removed, including to build features such as price estimates for an area, and market reports that we may share or sell.
Search engines may keep copies of public pages after they are removed. We cannot control those copies.
You must own the photos you post or have permission to use them. Anyone who believes content infringes their rights may write to our Grievance Officer.
The PropertyNaksha name, logo, design and software, and the market data and reports we compile, belong to us.
If you send us ideas or suggestions, we may use them freely without owing you anything.
13. Third-party services
Sign-in is provided by Google, and maps are provided by Google Maps. Your use of those features is also subject to Google’s terms. We are not responsible for the availability or conduct of any third-party service.
14. Disclaimers and limitation of liability
The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted or error-free, that any listing is accurate or still available, or that any transaction will take place. Any transaction is solely between the buyer and the seller.
Users are responsible for what they post about others. Anyone who believes content on the Service defames them may write to our Grievance Officer. We may remove it at our discretion, and we will remove it when a court order or the law requires us to.
To the fullest extent permitted by law, we are not liable for any indirect or consequential loss, or for any loss arising from a transaction between users.
We are not responsible for any loss of business, commission or customers that you believe results from the Service or from how other users use it.
We take reasonable measures to protect the Service and your data, but no system is completely secure. To the extent permitted by law, we are not liable for any loss caused by unauthorised access to the Service or your data that happens despite those measures. If a breach affects your data, we will tell you as the law requires.
If we are ever found responsible for a loss, our share is limited to the fees for your plan for the three months before it, or ₹1,000, whichever is more.
Nothing on the Service is legal, financial or valuation advice. Price estimates and market reports are estimates only, and must not be relied on to value, buy or sell a property.
15. Indemnity
You agree to indemnify us against any claims, losses and costs, including reasonable legal fees, arising from your content, your use of the Service, or your breach of these Terms. This includes our losses and costs, including reasonable legal fees, from any claim or complaint you make against us that a court or authority finds to be false, frivolous or made in bad faith, and from any threat, abuse or harassment by you against us or anyone who works with us.
16. Changes to the Service and these Terms
We may change, suspend or discontinue any part of the Service at any time. We may update these Terms. The date at the top shows the current version. Where a change is significant, we will tell you in the app. If you continue to use the Service after a change, you accept the updated Terms.
17. Governing law and jurisdiction
These Terms are governed by the laws of India. The courts at Pehowa, Haryana have exclusive jurisdiction over any dispute arising from these Terms or the Service. Where a court at Pehowa does not have the power to hear a dispute, the courts at Kurukshetra, Haryana have exclusive jurisdiction.
